The pensioner's lawyer submitted a mitigation letter explaining his health difficulties, including Parkinson's disease and Alzheimer's, and the fact that his wife's caregiver had overlooked paying his tax renewal.

The Single Justice Procedure allows magistrates to sit behind closed doors and deal with low-level cases, but critics argue that this process can result in prosecutors missing important information that could question the public interest of a prosecution.

The Government has been considering reforms to the Single Justice Procedure, including a mandatory prosecution check of each case after defendants have entered their mitigation.

However, the Government has yet to make any public announcements on possible changes to the system, leaving concerns over its fairness and effectiveness unresolved.

On the same day as the pensioner's case, 60 other defendants were convicted and sentenced in DVLA cases, with fines, costs, court fees, and compensation totalling almost £25,000.

Court data shows that 1,950 people across England and Wales were prosecuted last week in the Single Justice Procedure for keeping or using a vehicle while their vehicle tax was unpaid.
