Prosecutors argue the evidence places little doubt that the 23‑year‑old defendant should be bound over for trial on all seven charges related to the fatal shooting of a conservative activist.
They contend that the defendant planned the attack for more than a week, intentionally targeted the victim, and knowingly endangered bystanders by firing a high‑powered rifle into a crowd gathered for a speech.
The evidence, prosecutors say, satisfies the state’s probable‑cause standard at this stage of the case, a conclusion that Judge Graf is considering after a five‑day preliminary hearing.
Rather than issuing an immediate ruling, the judge requested written arguments. The defense is expected to file its opposition in the coming weeks, followed by a final response from prosecutors before oral arguments are scheduled for September 1.
The defendant has not yet entered a plea and faces aggravated murder along with six additional felony and misdemeanor charges stemming from the killing.
If probable cause is found, the case will proceed to trial, and prosecutors are seeking the death penalty on the aggravated murder charge.
