The program expired last month amid disputes over Pulte's leadership, despite Republican warnings that its absence could weaken national security capabilities.
Clayton's nomination faced opposition from Democrats who questioned his qualifications for the role. Senator Adam Schiff of California criticized the selection, arguing that politicized leadership in intelligence positions puts Americans at greater risk.
Section 702 enables the government to collect intelligence on foreigners abroad while incidentally capturing communications involving Americans. Senator Mark Warner of Virginia indicated that immediate pressure to reauthorize FISA has diminished now that a permanent DNI is in place. He noted that communication providers remain cooperative, reducing the urgency of the situation.
